Insolvency Law

We offer practical, client-focused advice in the area of corporate restructuring and personal insolvency.

Together with expert financial advisors we carefully assess each individual case. Such analysis would typically include an in-depth review of loan, security and any other relevant documentation.
Once the analysis is complete we will be in a position to advise on a full range of possible remedies as follows:

  • Voluntary arrangements with creditors
  • Restructuring
  • Mediation/dispute resolution
  • Out of court settlements
  • Formulation of debt restructuring proposals
  • Options on dealing with arrears

We advocate active engagement between borrowers and lenders in seeking to find the optimal outcome for our clients.

In circumstances where it is not possible to negotiate a settlement to the mutual satisfaction of borrower and lender, we then advise on the next stage of options, including the following:

  • Litigation
  • Examinership
  • Bankruptcy law
  • Receiverships, liquidations

Mortgage arrears and other personal borrowing arrears are increasingly becoming a significant problem for many borrowers. We provide expert advice on dealing with this problem. We will also be in a position to advise our clients on any changes to the law currently under consideration by the Mortgage Arrears and Personal Debt Expert Group. This Group is currently formulating proposals to Government to tackle the issue of Mortgage Arrears. We will ensure our clients are made aware of every option available to them under the law.
